Terms of Service

These Terms of Service ("Terms") govern your use of TrunkCall and its associated platforms, including trunkcall.app, brands.trunkcall.app, justyou.trunkcall.app, and any related mobile applications (collectively, the "Platform"), operated by TMF International ("we", "us", or "the Company"), a company registered in Ras Al Khaimah, United Arab Emirates.

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Description of Service

TrunkCall is a platform that connects people seeking expertise and guidance with individuals and organisations who can help. The Platform enables users to communicate via audio calls, video calls, chat messaging, group sessions, and structured courses. We also provide tools for experts and brands to manage their profiles, bookings, availability, and earnings.

2. Account Registration

To use certain features of the Platform, you must create an account using your phone number. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Promptly update your information if it changes
• Accept responsibility for all activity that occurs under your account
• Not create multiple accounts or transfer your account to another person

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

3. User Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws
• Harass, abuse, threaten, or intimidate other users
• Impersonate any person or entity, or misrepresent your qualifications or affiliation
• Share content that is defamatory, obscene, or infringes on intellectual property rights
• Attempt to gain unauthorised access to the Platform or its systems
• Use automated tools, bots, or scrapers to access or collect data from the Platform
• Interfere with or disrupt the Platform or servers
• Circumvent any payment mechanisms or attempt to avoid fees

4. Expert and Creator Terms

If you register as an expert, creator, or service provider on the Platform, you additionally agree to:

• Provide services honestly and to the best of your ability
• Not misrepresent your qualifications, expertise, or credentials
• Honour booked sessions and be available during your stated availability times
• Comply with all applicable professional regulations and licensing requirements
• Not solicit users to transact outside the Platform to avoid fees

The Platform is a facilitator of connections. We do not endorse, certify, or guarantee the qualifications or quality of any expert or service provider.

5. Brand Listings

Organisations that list on Brands by TrunkCall must provide accurate business information, ensure their listed team members are authorised representatives, and comply with all applicable regulations in their operating jurisdictions. We reserve the right to remove any brand listing that violates these Terms or fails our verification process.

6. Payments, Wallet, and Refunds

The Platform facilitates payments between users and service providers. By using our payment features, you agree that:

• All prices are displayed before you confirm a transaction
• Payments are processed through third-party payment processors
• Wallet balances and coin purchases are non-refundable except as required by applicable law or at our sole discretion
• We charge a platform fee on transactions, which is disclosed before payment
• Expert/creator earnings are subject to a holding period before becoming eligible for payout
• We may suspend payouts if we suspect fraud or violation of these Terms

Refund requests are reviewed on a case-by-case basis. If a session does not occur due to the expert's fault, you are entitled to a full refund. Disputes can be raised through the Platform and will be resolved at our reasonable discretion.

7. Intellectual Property

All content, design, trademarks, logos, and software associated with the Platform are owned by or licensed to TMF International and are protected by intellectual property laws.

Content you create and share on the Platform (such as your profile, messages, and session materials) remains yours. By posting content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and distribute that content as necessary to operate the Platform.

8. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or secure. We do not guarantee the accuracy, reliability, or quality of any advice, information, or services provided by users or experts on the Platform.

9. Limitation of Liability

To the maximum extent permitted by applicable law, TMF International and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform. Our total liability for any claim arising from these Terms or your use of the Platform shall not exceed the amount you have paid to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless TMF International and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and indemnification.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the Emirate of Ras Al Khaimah and the applicable federal laws of the United Arab Emirates. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ras Al Khaimah, UAE.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the Platform.
